1. Acceptance of Terms
These Website and Service Terms ("Terms") are an agreement between you and SNS Health and Wellness Center ("SNS," "we," "us," or "our"). By accessing our website, submitting a form, booking or purchasing a service, or using an SNS online service, you agree to these Terms and our Website Privacy Policy. If you do not agree, do not use the website or online services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into an agreement to use our website, book services, or make a purchase. By using the website or booking, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Services and Geographic Limits
SNS offers services that may include functional and wellness care, telehealth, occupational and laboratory services, DOT physical examinations, drug testing, veteran-focused examinations, DBQs, independent medical opinions, nexus letters, second opinions, and related educational or administrative services. Service descriptions are general and may change.
In-person services are available only in Georgia. Virtual services are available only where SNS confirms that the service is appropriate and lawful and the professional is authorized to provide it. You must accurately disclose your physical location for a virtual appointment. Booking software may allow you to request an appointment that SNS cannot legally or clinically fulfill; confirmation and payment do not override licensing rules.
4. No Emergency Services
SNS does not provide emergency medical services through the website, contact forms, email, text messaging, Practice Better, or virtual appointments. Do not use these channels for urgent or emergency concerns. Call 911 or go to the nearest emergency department if you believe you are experiencing a medical emergency.
5. Website Information Is Not Individual Medical Advice
Website, blog, social-media, downloadable, and promotional content is provided for general education and is not a diagnosis, prescription, treatment plan, legal opinion, or substitute for individualized care. A clinician-patient relationship is established only when SNS expressly accepts you for a clinical service and applicable intake, consent, and clinical requirements are completed. Purchasing a nonclinical service or viewing content does not by itself create such a relationship.
6. Veteran Examination and Documentation Terms
SNS is an independent healthcare provider and is not the U.S. Department of Veterans Affairs, is not affiliated with or endorsed by VA, and is not a law firm or veterans service organization.
SNS provides independent medical evaluation and documentation within the provider’s professional scope. SNS does not promise that a DBQ, nexus letter, independent medical opinion, examination, or other document will result in service connection, a particular disability rating, payment of benefits, or any other outcome.
Clinical opinions must remain independent and supported by the available history, records, examination findings, and medical evidence. Payment does not purchase a favorable opinion. SNS may decline to issue, revise, or sign a requested opinion when professional standards are not met.
The veteran is responsible for providing complete, accurate, legible, and timely records and for identifying applicable deadlines. SNS is not responsible for claim strategy, filing a claim or appeal, preserving legal deadlines, or providing legal representation.
Medical records must be submitted through Practice Better or another secure method approved by SNS. Submitting incomplete or late records may delay the appointment or document.
7. Occupational, Laboratory, and DOT Services
Testing and examination outcomes depend on applicable medical standards, specimen integrity, chain-of-custody requirements, laboratory procedures, federal and state rules, employer policies, and the information provided. SNS does not guarantee certification, employment, a negative test result, acceptance by an employer or agency, or a particular outcome. You must provide accurate identification, medical history, medication information, and specimens and follow all collection and examination instructions.
8. Functional Medicine, Wellness, and Telehealth
Health outcomes vary. SNS does not guarantee symptom resolution, weight change, laboratory results, prevention of disease, or any particular outcome. Recommendations may include laboratory testing, nutrition, lifestyle measures, supplements, referral, or conventional medical care as clinically appropriate. You remain responsible for telling SNS about medications, supplements, allergies, diagnoses, pregnancy status, and care from other professionals. Do not stop or change prescribed medication without consulting the prescribing clinician.
9. Booking, Intake, and Attendance
An appointment request is not final until accepted or confirmed by SNS.
You must complete requested intake forms, identity verification, consents, record uploads, and payments by stated deadlines.
SNS may reschedule, shorten, or cancel an appointment when required information is missing, safety or professional concerns arise, the requested service is outside scope, or circumstances beyond SNS’s reasonable control occur.
You are responsible for a suitable device, internet connection, private setting, and accurate physical-location information for virtual services.
Separate cancellation, late-arrival, rescheduling, no-show, or document-revision rules presented during booking or intake are incorporated into these Terms.
10. Fees, Payments, and Refunds
Prices are presented at booking, in a proposal, or in a service-specific agreement and may change before purchase. Unless expressly stated otherwise, services are self-pay. Payment may be processed through Square or another approved processor. You authorize the processor and SNS to charge the amounts presented to you, including any properly disclosed deposits or fees.
Refunds are not automatic. SNS may issue a full or partial refund when SNS determines that an error or failure attributable to SNS occurred or when specific circumstances warrant an exception. Factors may include whether professional time, record review, testing, supplies, third-party charges, appointment capacity, or documentation work has already been incurred. Except where required by law or expressly agreed in writing, completed professional services, completed record reviews, issued reports, laboratory charges, supplements, payment-processing charges, and missed appointments are generally nonrefundable. Requesting a refund does not guarantee approval.
If SNS cancels a paid service and does not provide a reasonable replacement or rescheduling option, SNS will determine the appropriate refund or credit. Any separate written financial policy given at booking controls if it is more specific and does not conflict with applicable law.
11. Communications and Marketing
By providing contact information, you authorize SNS to contact you about your inquiry, booking, payment, records, or service. If you give separate marketing consent, SNS may send recurring promotional emails or text messages. Consent to marketing is not a condition of purchase. Message frequency varies and message and data rates may apply. Reply STOP to a marketing text to opt out and HELP for assistance. Use the unsubscribe link to stop promotional email. You remain responsible for keeping your contact information current.
12. Privacy and Electronic Communications
Our Website Privacy Policy and, where applicable, Notice of Privacy Practices govern information handling. Ordinary email, standard text messages, website forms, and social-media messages may not be secure. Do not transmit medical records or highly sensitive information through those channels unless SNS specifically approves the method. Use Practice Better or another secure channel designated by SNS for veteran and medical records.
13. User Responsibilities and Prohibited Conduct
You agree not to:
Provide false, misleading, altered, incomplete, or unauthorized information or records.
Impersonate another person; misuse another person’s payment method, identity, health information, or account; or access a service without authorization.
Interfere with website security or operation, introduce malicious code, scrape or copy content through automated means, or attempt to reverse engineer an online service.
Use SNS content, forms, reports, credentials, trademarks, or professional work product in a misleading, unlawful, fraudulent, or defamatory manner.
Record an appointment without obtaining all consent required by law and by SNS policy, or threaten, harass, abuse, or endanger staff, contractors, patients, or partners.
14. Intellectual Property
The website and its original text, graphics, branding, forms, educational materials, program names, and other content are owned by or licensed to SNS and are protected by applicable law. SNS grants you a limited, revocable, nonexclusive right to use the website for personal, lawful purposes. Clinical records and reports may be used for their intended personal, medical, employment, administrative, or legal purpose, but you may not alter a report, misrepresent its author, remove qualifications, or sell or commercially republish SNS materials without written permission.
15. Third-Party Services
Our website may use or link to third-party services such as HighLevel/LeadConnector, Practice Better, Square, laboratories, supplement vendors, and social-media platforms. Their separate terms and policies may apply. SNS is not responsible for an independent third party’s content, downtime, decisions, or conduct, except to the extent responsibility cannot lawfully be excluded.
16. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND GENERAL ONLINE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." SNS DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS. NOTHING IN THESE TERMS DISCLAIMS A PROFESSIONAL DUTY THAT CANNOT LAWFULLY BE DISCLAIMED, LIMITS RIGHTS THAT CANNOT BE WAIVED, OR ELIMINATES RESPONSIBILITY FOR PROFESSIONAL NEGLIGENCE WHERE APPLICABLE LAW PROVIDES OTHERWISE.
17. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE WEBSITE, DELAYED OR FAILED ELECTRONIC COMMUNICATIONS, THIRD-PARTY PLATFORMS, OR UNAUTHORIZED USE OF YOUR CREDENTIALS. FOR CLAIMS RELATING ONLY TO A WEBSITE PURCHASE OR NONCLINICAL DIGITAL SERVICE, SNS’S AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID SNS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. THIS SECTION DOES NOT LIMIT LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY THAT MAY ARISE FROM PROFESSIONAL SERVICES UNDER APPLICABLE LAW.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold SNS and its owners, personnel, and contractors harmless from third-party claims arising from your unlawful misuse of the website, violation of these Terms, infringement of another person’s rights, or submission of information or records you were not authorized to provide. This obligation does not require you to indemnify SNS for SNS’s own professional negligence or unlawful conduct.
19. Suspension or Termination
SNS may restrict website access, decline or discontinue nonemergency services, or terminate an online relationship when reasonably necessary for safety, professional judgment, nonpayment, abusive conduct, fraud, repeated policy violations, lack of clinical appropriateness, licensing limitations, or legal compliance. Any termination of an established clinical relationship will be handled consistent with applicable professional obligations.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Before filing a lawsuit concerning these Terms, the parties should first provide written notice describing the dispute and make a good-faith effort for at least 30 days to resolve it informally. Unless applicable law requires otherwise, proceedings relating solely to website use or a nonclinical purchase must be brought in a state or federal court with jurisdiction in or serving Henry County, Georgia. Claims involving professional services remain subject to all applicable healthcare laws and procedural requirements.
21. Changes and Severability
SNS may revise these Terms by posting an updated version with a new effective date. Changes apply prospectively unless law permits otherwise. If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver.
